Late businessman wasn\u2019t worried about undersea tunnel probe, Guan Eng\u2019s trial told.<\/strong><\/p>\n\n\n\n\n\n\n\n

KUALA LUMPUR – June 7: The Lim Guan Eng<\/strong> corruption trial was today told that a key witness, a prominent businessman who had fallen to his death, had not been under pressure when questioned by authorities investigating the undersea tunnel project.<\/p>\n\n\n\n

Malaysian Anti-Corruption Commission (MACC) officer Mohamad Hambi<\/strong>a told the sessions court that Ewe Swee Kheng<\/strong> was neither fearful nor worried about his safety, contradicting evidence given by his colleague.<\/p>\n\n\n\n

Mohamad said he took statements from Ewein Bhd<\/strong> founder and executive chairman Ewe on July 22 and 24, 2020, at the commission\u2019s Putrajaya headquarters.<\/p>\n\n\n\n

During cross-examination by lawyer Gobind Singh Deo<\/strong>, Mohamad said Ewe had made no mention of being \u201cfearful\u201d, nor did he appear worried about his safety.<\/p>\n\n\n\n

\u201cWas it your duty to ensure a witness (like Ewe) was comfortable when you recorded his statement?\u201d Gobind asked. Mohamad replied in the affirmative.<\/p>\n\n\n\n

The court had earlier heard testimony from Mohamad\u2019s colleague, Nazree Mansor<\/strong>, who recorded three statements from Ewe between July 2020 and Aug 14, 2021.<\/p>\n\n\n\n

Nazree had told the court that Ewe was worried about his safety after making a \u201cconfession\u201d in the undersea tunnel case.<\/p>\n\n\n\n

Ewe, who was supposed to testify in Lim\u2019s trial, died on Oct 5, 2021 after falling from his 16-storey luxury condominium unit in Penang and landing in a swimming pool. His last statement, recorded on Aug 14 last year, was tendered in Lim\u2019s trial.<\/p>\n\n\n\n

To a question from Gobind as to whether Mohamad knew which political coalition was the government of the day in July 2020, the witness said the question was inappropriate.<\/p>\n\n\n\n

However, trial judge Azura Alwi<\/strong> reminded him to answer the question and not to pass judgment.<\/p>\n\n\n\n

Gobind then interjected, \u201cyou don\u2019t have to be scared\u201d.<\/p>\n\n\n\n

The lawyer then pointed out that in July 2020 \u2013 five months after the fall of the Pakatan Harapan government \u2013 Lim was no longer the finance minister or Penang chief minister.<\/p>\n\n\n\n

Mohamad agreed with Gobind\u2019s statement.<\/p>\n\n\n\n

The officer also read out parts of Ewe\u2019s answers in the latter\u2019s witness statements.<\/p>\n\n\n\n

\u201cHe told us he did not give YB Lim or Lim Hock Seng<\/strong> anything to obtain the Lot 702 land,\u201d Mohamad said, making reference to Hock Seng, the former Penang exco in charge of public works, public utilities and transportation.<\/p>\n\n\n\n

Ewein Zenith<\/strong>, a joint-venture vehicle of Ewein Land Sdn Bhd<\/strong> and Consortium Zenith BUCG Sdn Bhd<\/strong>, launched the RM800 million City of Dreams<\/em> service apartments project in Bandar Tanjong Pinang in 2016.<\/p>\n\n\n\n

The land on which the project was built is part of the land mentioned in Lim\u2019s corruption case.<\/p>\n\n\n\n

Lim is standing trial on charges of using his position as then Penang chief minister to ask Consortium Zenith BUCG Sdn Bhd<\/strong> director Zarul Ahmad Mohd Zulkifli<\/strong> for a 10% cut of the profits from the undersea tunnel project and accepting RM3.3 million in kickbacks from the businessman.<\/p>\n\n\n\n

He is also accused of two counts of dishonestly misappropriating RM208.7 million worth of state land to two companies.<\/p>\n\n\n\n

The hearing continues on June 23, when the defence will further cross-examine former Penang legal adviser Faiza Zulkifli<\/strong>.<\/p>\n\n\n\n
